ZFX Encode® Converter Privacy Policy

Thank you for using the Zfx Encode® Converter software (“Encode” or the “Software”).  Zfx GmbH (collectively, “Zfx,” “we,” “us,” or “our”), an affiliate of Biomet 3i, Zimmer Dental, Zimmer Biomet Dental, Zimmer Biomet Holdings, Inc., among other companies provides this Privacy Policy (“Policy”) to describe how we collect, use, share, and otherwise process the information of our customers (“customers”) that use the Software.

Information we collect

During registration, we collect information about our customers, including the lab name, address, and email address. We also collect information about our customer’s relationship with Zfx, including the customer’s Zfx account number, Zfx representative name, and the Zfx representative’s country.

When you use the Software, we also automatically collect certain technical information. This information is automatically sent whenever you use the Software.  This information includes Internet Protocol address, browser type, browser language, device type and Machine Key, advertising IDs associated with your device (such as Apple’s Identifier for Advertising or Android’s Ad ID), the date and time of your request, and Uniform Resource Locators, or URLs (i.e., website addresses) visited prior to arriving at and after leaving our Software.

How we use the information we collect

We use the information we collect for any lawful purpose, including:

  • To deliver the Software, including to create customer accounts;
  • To respond to your inquiries;
  • To operate and improve our Software, including for monitoring and analytics purposes;
  • To prevent or detect fraud;
  • To comply with the law and to maintain the security of our Software; or
  • With your consent, or as otherwise disclosed at the time information is collected.

We do not use automatic decision-making (i.e., making decisions solely by automated means without any human involvement) or profiling (i.e., automated processing of personal information to evaluate certain aspects of an individual).

How we share the information we collect

We may share the information we collect, with third parties, including:

 

  • With third parties who help provide the Software;
  • With third party vendors who process data on our behalf to help us deliver the Software and related services, such as [email service providers or third parties that help us conduct research and analysis];
  • As part of a corporate sale, merger, or acquisition, or other transfer of all or part of our assets, including as part of a bankruptcy proceeding;
  • Pursuant to a subpoena, court order, governmental inquiry, or other legal process or as otherwise required by law, or to protect our rights or the rights of third parties;
  • With your consent or as otherwise disclosed at the time of data collection or sharing.

We may share information that has been anonymized or aggregated without limitation.

 

International users

This section applies to those that use our Software from the European Economic Area, Switzerland, or the United Kingdom.

Sometimes, we process personal information with your consent. On other occasions, we may process personal information when necessary to fulfill a contract or where required to do this by law.  We may also process personal information when it is in our legitimate interests to do this (e.g., for customer service, for product development, or for safety and security purposes) and when these interests are not overridden by your data protection rights.

Please be aware that the personal information we collect may be transferred to and maintained on servers or databases located outside your state, province, country, or other jurisdiction, where the privacy laws may not be as protective as those in your location.

You have a right to the following:

  • To request access to the personal information we hold about you;
  • To request that we rectify or erase your personal information;
  • To request that we restrict or block the processing of your personal information;
  • Under certain circumstances, to receive personal information about you that we store and transmit to another without hindrance from us, including requesting that we provide your personal information directly to another, i.e., a right to data portability; and
  • Where we previously obtained your consent, to withdraw consent to processing your personal information.

To exercise these rights, contact our [Data Protection Officer] using the “Contact Us” section below.  Please be aware that we may be unable to afford these rights to you under certain circumstances, such as if we are legally prevented from doing so.

Additionally, you have the right to lodge a complaint against us.  To do so, contact the supervisory authority in your country of residence.

Retention

We will process and store your information only for the period necessary to achieve the purpose of the storage, or as permitted by law.  The criteria used to determine the period of storage of information is the respective statutory retention period.  After expiration of that period, the corresponding information is routinely deleted, as long as it is no longer necessary for the fulfillment of a contract or the initiation of a contract.

Updating your information        

You can update the information attached to your account by logging into your account and changing that information.

Links to other websites

Our Software may contain links to other websites or apps that are not owned or operated by Zfx.  If any such links are provided, You should carefully review the privacy policies and practices of these websites or apps before visiting them, as we cannot control and are not responsible for their privacy policies or practices.

Changes to this Privacy Policy

We update this Policy from time to time and will post changes on this page.  You should review this Policy periodically to stay aware of changes.
